2008 Priority Bills - Senate

SB 790 (Schoenberg, J.) - This is the fund sweeps bill, which would permit the Governor beginning on July 1, 2008 - June 30, 2009 to transfer (sweep) up to a total of $530 million from any fund or funds held by the state comptroller.  Such funds would be limited to the payment of Medicaid obligations, state financial obligations that secure federal funds or obligations of the State Board of Education.  The Open Space Lands Acquisition and Development program (OSLAD) is specifically exempted.  Passed the Senate on 5/29/2008 with a vote of 37-21Passed the House on September 16, 2008 with a vote of 97-16.

SB 1102 (Trotter, D.) - Makes FY09 appropriations and reappropriations to various officers and agencies. Effective July 1, 2008.  Provides $3,000,000 for park districts and other entities as provided by the "Illinois Horse Racing Act of 1975" and to public museums and aquariums located in park districts, as provided by "An Act concerning aquariums and museums in public parks" and the "Illinois Horse Racing Act of 1975" as now or hereafter amended.  Passed the Senate on 5/23/2008 with a vote of 36-19.  Passed the House on 5/31/2008 with a vote of 64-50-1.

SB 1865 (Noland, M.) - Amends the Parental Responsibility Law. Increases the limitation on damages recoverable under that Law, from $20,000 to $200,000.  Passed the Senate on 4/17/2008 with a vote of 54-0.  Passed the House on 5/30/2008 with a vote of 113-0.

SB 1890 (Haine, W.) - Public Construction Bonds.  SB 1890 would have increased the contract amount that triggers a surety bond requirement on public contracts to $100,000 from $5,000.  SB 1890 as amended requires a surety bond for state projects that exceed $50,000. Units of local government maintain the $5,000 requirement.  Passed the Senate on 4/17/2008 with a vote of 54-0. Passed the House on 5/30/2008 with a vote of 113-0.

SB 1941 (Haine, W.) - Amends the Recreational Use of Land and Water Areas Act. Adds entry onto the land of another to conduct horseback riding with the rider's own horse or carriage driving to the definition of "recreational or conservation purpose".

Replaces everything after the enacting clause. Amends the Recreational Use of Land and Water Areas Act. Makes a technical change in a Section concerning definitions.

SB 1957 (Clayborne, J.) - Amends the Illinois Municipal Retirement Fund Article of the Illinois Pension Code. Gives the annuitant trustee the right to vote on any and all actions before the board of trustees and increases from 4 to 5 the number of concurring votes necessary for every decision or action by the board of trustees. Effective immediately.  Passed the Senate on 4/1/2008 with a vote of 49-0-1.  Passed the House on 5/30/2008 with a vote of 113-0.

SB 1959 (Clayborne, J.) - Amends the Illinois Municipal Retirement Fund Article of the Illinois Pension Fund. Changes how a supplemental benefit payment is calculated.  Provides that the amount of the supplemental benefit payment to each eligible person shall be 75% of the monthly retirement of surviving spouse annuity payable to that person in June preceding the July 1 supplemental benefit payment date.  Adds the percentage of earnings of the participating employees of all participating municipalities and participating instrumentalities necessary to provide that year's supplemental benefit payment to the list of considerations in determining the municipal contribution rate.  Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

SB 1960 (Clayborne, J.) - Amends the Illinois Municipal Retirement Fund Article of the Illinois Pension Code. Changes the minimum number of years of service an employee must have to be eligible for a retirement annuity from 8 to 5. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

SB 2311 (Garrett, S.) - Creates the Transportation Enhancements and Safe Routes to School Transparency Act. Establishes grants review committees, appointed by the Secretary of Transportation, to evaluate, score, and rank all applications for funding under the federal Transportation Enhancements Program and the Safe Routes to School Program. Sets forth the grants review process. Provides that application evaluation, scoring, and ranking decisions of the committees are binding upon the Department. Contains other provisions. Effective immediately.  Passed the Senate on 4/10/2008 with a vote of 56-0.

SB 2369 (Garrett, S.) - Creates the Phosphorous Turf Fertilizer Use Restriction Act. Provides that, beginning July 1, 2009, a person may not apply a fertilizer containing the plant nutrient phosphorus to turf in this State. Provides that the restriction does not apply when (i) a tissue, soil, or other test by a laboratory or method approved by the Agency and performed within the immediately preceding 3 years indicates that the level of available phosphorus in the soil is insufficient to support healthy turf growth or (ii) the property owner or an agent of the property owner is first establishing turf via seed or sod procedures, but only during the first growing season. Sets a maximum fine for violation of the restriction. Provides that the University of Illinois Extension Service, in cooperation with the Environmental Protection Agency, shall study and evaluate phosphorus needs of turf throughout the State and develop the standard for the minimum amount of available phosphorus needed to support healthy turf growth. Requires the Environmental Protection Agency to produce consumer information on use restrictions and recommended best practices for lawn fertilizer containing phosphorus and on the best management practices for other residential sources of phosphorus in the urban landscape. Effective immediately.

SB 2399 (Link, T.) - Amends the Genetic Information Privacy Act. Adds several definitions. Provides that the Act applies to the State and local governments. Provides that an employer, employment agency, labor organization, and licensing agency shall not directly or indirectly do any of the following: (1) solicit, request, require or purchase genetic information of a person or administer a genetic test to a person as a condition of employment, preemployment application, labor organization membership, or licensure; (2) affect the terms, conditions, or privileges of employment, preemployment application, labor organization membership, or licensure, or terminate the employment, labor organization membership, or licensure of any person because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); (3) limit, segregate, or classify employees in any way that would deprive or tend to deprive any employee of employment opportunities or otherwise adversely affect the status of the employee as an employee because of genetic information with respect to the employee or family member (or information about a request for or the receipt of genetic testing by such employee or family member of such employee); (4) retaliate through discharge or in any other manner against any person alleging a violation of this Act. Makes other changes. Preempts home rule.  Passed the Senate on 4/16/2008 with a vote of 58-0.  Passed the House on 5/30/2008 with a vote of 114-0.

SB 2788 (Harmon, D.) - Amends the Chicago Park District Act. Provides that the Chicago Park District may sell, lease, or otherwise convey all or any portion of District-owned property that is used solely and exclusively as office or administrative space.  Passed the Senate on 4/1/2008 with a vote of 49-0-1.  Passed the House on 5/30/2008 with a vote of 113-0.

SB 3046 (Harmon, D.) - Amends the Cook County Forest Preserve District Act. Changes the definition of "Board". Provides that the commissioners of the Forest Preserve District of Cook County shall be elected in a countywide election (instead of the county board of commissioners serving as the board). Provides the election procedures and terms of office for commissioners. Specifies the procedure for selecting a president of the board. Provides that the president, with the advice and consent of the board of commissioners, may appoint officers. Specifies the procedure for filling a vacancy in the position of president and commissioner. Removes the president's veto power. Amends the Election Code. Provides that, at the general election in the appropriate odd-numbered years, the offices of commissioner of the Forest Preserve District of Cook County shall be filled.
